Digital Download Terms

These Digital Download Terms apply when you purchase or obtain a digital product through any LinkStacked creator's public profile. They supplement the main Terms of Service and govern your rights to access, download, and use purchased files.

The contract for each digital product purchase is between you (the buyer) and the creator (the seller). LinkStacked facilitates the transaction as a technology platform and is not a party to the sale.

Unless the product listing explicitly states otherwise, purchasing a digital product grants you a:

• Personal, non-exclusive, non-transferable licence to download and use the file for your own lawful purposes
• Right to download the file for as long as the download link is valid (see Section 3 for link expiry)

You are not purchasing:

• Ownership of the underlying intellectual property, copyright, or trademark
• The right to resell, sublicence, or redistribute the file (unless the seller explicitly grants a commercial licence in the product description)
• Ongoing support, updates, or new versions (unless stated in the listing)
• A customisation, consultation, or service — digital downloads are self-serve products

After successful payment confirmation, LinkStacked delivers access via:

• A secure, time-limited download link (valid for 5 minutes per generation; can be regenerated from your purchase confirmation email up to 5 times)
• A purchase confirmation email to the address you provided at checkout
• Your account's purchase history (if you completed checkout while logged in)

We cannot guarantee indefinite re-download access. If a creator removes or unpublishes a product, existing buyers retain access to previously generated links for 90 days. After that, LinkStacked is not obligated to provide continued access.

As a buyer, you must not:

• Resell, sublicence, or redistribute the file or substantial portions of it without the seller's written permission
• Share your download link publicly or post it where non-buyers can access it
• Use the file to infringe any third-party copyright, trademark, or other intellectual property right
• Misrepresent the file as your own original work when it is not, in contexts where attribution matters
• Use the file for illegal purposes or in violation of these Terms or applicable law
• Extract or repurpose embedded personal data, trademarks, or brand assets included in the file for unrelated purposes

Where the product description grants broader usage rights (e.g. "commercial use allowed", "attribution not required"), the product description governs for that listing.

At checkout, you will be asked to explicitly confirm: "I understand this is a digital download delivered immediately. I consent to immediate delivery and acknowledge that I waive my right of withdrawal upon download."

Exceptions where a refund or replacement may be provided:

• The download link was broken or expired before you could access the file (contact us within 48 hours)
• The delivered file is fundamentally different from the product description (wrong file delivered)
• The file contains malware or harmful code (report to safety@linkstacked.com immediately)
• You were charged for the purchase fraudulently without your authorisation
• A technical error on our end resulted in a duplicate charge

Filing a chargeback with your bank rather than following our dispute process may result in your LinkStacked account being temporarily suspended pending investigation.

We take chargebacks seriously and will cooperate fully with your bank's investigation, providing purchase records, download logs, and delivery confirmation. Filing a chargeback for a product that was delivered as described may result in your account access being permanently revoked.

If you have a genuine concern, please contact us first at legal@linkstacked.com — we can often resolve issues faster than a chargeback process.

Under the EU Consumer Rights Directive (2011/83/EU) and German BGB §356, consumers have a 14-day right of withdrawal from digital content purchases. However, this right is waived when:

• The consumer has <strong>explicitly consented</strong> to immediate digital delivery before the withdrawal period expires, <strong>and</strong>
• The consumer has <strong>acknowledged</strong> that they thereby waive their right of withdrawal

Our checkout flow collects this explicit consent from EU consumers before processing payment. If you are an EU consumer and you have not yet downloaded the file, you may exercise your right of withdrawal within 14 days of purchase by contacting us at legal@linkstacked.com.

Before contacting us, we encourage you to resolve disputes with the creator directly — they have the most information about their product and can often resolve issues quickly.

If you cannot reach the creator or your issue is unresolved after 5 days, contact us at legal@linkstacked.com with:

• Your order reference number (from your receipt email)
• A clear description of the issue
• Screenshots or evidence where relevant

We aim to respond within 5 business days and will adjudicate disputes in good faith.
